II. Natura del servizio
 
1. MB Toptutor academy fornisce un servizio di ripetizioni scolastiche online basato sull’acquisto di ore singole, “pacchetti ore” e dispense o ebook appositamente studiati per venire incontro a qualsiasi esigenza didattica degli studenti.
 
 
III. Limitazione di responsabilità
 
1. MB Toptutor academy non è responsabile per eventuali problemi tecnici relativi alla connessione internet che non dipendono da MB Toptutor Academy o dai suoi insegnanti, pertanto qualora la lezione non si effettui per problemi di connessione di qualsiasi genere dovuti al cliente questa non potrà essere rimborsata.
2. Nel caso in cui lo studente non si presenti a lezione essa non è rimborsabile.
 
3. Nel caso di ritardo esso non è recuperabile, un eventuale recupero di questo è a totale discrezione dell’insegnante, ma ciò non comporta da parte di MB Toptutor Academy un pagamento a quest’ultimo che vada oltre la tariffa oraria fissa stabilita tra MB Toptutor Academy e i suoi insegnanti.
 
 
IV. Account utente e restrizioni sui contenuti
 
1. L’account studente MB Toptutor Academy può essere utilizzato solamente da studenti maggiorenni o dai genitori degli studenti minorenni e da questi ultimi soltanto su delega espressa dei genitori.
 
2. Agli utenti siano essi insegnanti o studenti è vietato pubblicare o trasmettere attraverso il sito o il servizio di MB Toptutor Academy qualsiasi materiale illegale, dannoso, minaccioso, molesto, diffamatorio, volgare, osceno, sessualmente esplicito, discriminatorio o altrimenti discutibile di qualsiasi tipo, compreso, ma non solo, qualsiasi materiale che incoraggi una condotta che costituirebbe un reato penale,
 
darebbe luogo a responsabilità civile o violerebbe qualsiasi legge locale, statale, nazionale o internazionale.
V. Ordine, prezzi, metodi di pagamento e cancellazione
 
1. Gli acquirenti delle ore singole e dei pacchetti lezioni devono avere almeno 18 anni di età. Ci riserviamo il diritto di rifiutare il servizio a chiunque per qualsiasi motivo e in qualsiasi momento.
2. Dopo aver effettuato un ordine, i clienti riceveranno un’e-mail di conferma con il dettaglio dei prodotti ordinati e la relativa ricevuta di pagamento.
3. MB Toptutor Academy si riserva il diritto di annullare un ordine in qualsiasi momento in caso di circostanze impreviste, in tal caso il pagamento effettuato dal cliente verrà a questo restituito.
4. Il pagamento dei pacchetti di lezioni, delle dispense e degli ebook avviene esclusivamente online. Accettiamo i seguenti metodi di pagamento: carta di credito o di debito [Visa, MasterCard, e PayPal].
5. Dopo il loro acquisto, pacchetti lezione, ore singole, dispense ed ebook non sono rimborsabili.
6. Tutti i prezzi sono soggetti a modifiche senza preavviso.
 
7. I clienti hanno facoltà di annullare la lezione fino a 24 ore prima del suo svolgimento concordato, ogni cancellazione intervenuta oltre la suddetta tempistica comporterà che l’ora o le ore di lezione verranno considerate come svolte.
8. Per annullare una lezione, il cliente deve accedere tramite le proprie credenziali alla sezione dedicata del proprio account bookeo integrato all’interno dell’area riservata di MB Toptutor Academy e richiedere in autonomia l’annullamento.
9. pacchetti lezioni e ore singole devono essere consumati entro 9 mesi dall’acquisto, scaduto tale periodo verranno considerati come utilizzati e per fruire nuovamente del servizio sarà necessario acquistarli nuovamente.
 
 
VI. Diritto di recesso
 
Nel caso della vendita online il diritto di recesso riconosciuto per legge ai consumatori può essere escluso, acquistando le singole ore, i pacchetti ore, le dispense e gli ebook MB Toptutor Academy il cliente accetta l’esclusione del diritto di recesso sull’acquisto effettuato.
 
 
 
VII. Proprietà intellettuale
 
Le lezioni, le dispense, gli ebook di MB Toptutor Academy e ogni altro materiale o servizio offerto dal sito sono coperti dal diritto d’autore, pertanto è vietata ogni riproduzione o divulgazione non autorizzata espressamente da MB Toptutor Academy, acquistando i prodotti o i servizi di MB Toptutor Academy il cliente accetta espressamente tale clausola; qualsiasi violazione del diritto d’autore che copre i prodotti e i servizi forniti da MB Toptutor Academy sarà da questa tutelata nelle opportune sedi legali.
 
 
VIII. Istruzioni per la fruizione del servizio
 
1. Per poter usufruire dei servizi e prodotti MB Toptutor Academy, il cliente deve necessariamente iscriversi alla piattaforma MB Toptutor Academy tramite il form presente sul sito.
 
2. Per poter correttamente usufruire del servizio fornito da MB Toptutor Academy, il cliente è tenuto a utilizzare l’applicazione Google Meet, in quanto MB Toptutor Academy eroga il proprio servizio esclusivamente tramite tale piattaforma.
 
3. Utilizzando il sito web/applicazione MB Toptutor Academy, accettate di rispettare i presenti Termini e Condizioni. L’uso continuato di MB Toptutor Academy dopo la pubblicazione delle modifiche implica l’accettazione di essere legalmente vincolati da questi termini aggiornati e/o modificati.

  1. MB Toptutor Academy provides an online tutoring service based on the purchase of single hours, “hour packages,” and study materials or ebooks specifically designed to meet any educational needs of students.

 

III. Limitation of Liability

​

  1. MB Toptutor Academy is not responsible for any technical issues related to the internet connection that are not dependent on MB Toptutor Academy or its teachers. Therefore, if a lesson does not take place due to connection problems of any kind attributable to the client, it cannot be refunded.

  2. In the event that the student does not attend a lesson, it is non-refundable.

  3. In the case of lateness, the missed time cannot be made up. Any possible recovery is entirely at the discretion of the teacher, but MB Toptutor Academy will not make any payment to the teacher beyond the fixed hourly rate agreed between MB Toptutor Academy and its teachers.

 

IV. User Account and Content Restrictions

  1. The MB Toptutor Academy student account may only be used by adult students or by the parents of underage students, and by the latter only with the express authorization of their parents.

  2. Users, whether teachers or students, are prohibited from publishing or transmitting through the MB Toptutor Academy website or service any illegal, harmful, threatening, harassing, defamatory, vulgar, obscene, sexually explicit, discriminatory, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct constituting a criminal offense, gives rise to civil liability, or violates any local, state, national, or international law.

 

V. Ordering, Prices, Payment Methods, and Cancellations

  1. Purchasers of single hours and lesson packages must be at least 18 years old. We reserve the right to refuse service to anyone for any reason and at any time.

  2. After placing an order, customers will receive a confirmation email with the details of the products ordered and the related payment receipt.

  3. MB Toptutor Academy reserves the right to cancel an order at any time in the event of unforeseen circumstances. In such case, the customer’s payment will be refunded.

  4. Payment for lesson packages, study materials, and ebooks is made exclusively online. We accept the following payment methods: credit or debit card [Visa, MasterCard, and PayPal].

  5. Once purchased, lesson packages, single hours, study materials, and ebooks are non-refundable.

  6. All prices are subject to change without notice.

  7. Customers may cancel a lesson up to 24 hours before its scheduled time. Any cancellation made after this period will result in the hour(s) being considered as completed.

  8. To cancel a lesson, the customer must log in with their credentials to the dedicated section of their Bookeo account integrated within the MB Toptutor Academy reserved area and independently request cancellation.

  9. Lesson packages and single hours must be used within 9 months from purchase. After this period, they will be considered used, and to access the service again, a new purchase will be required.

 

VI. Right of Withdrawal

​

In the case of online sales, the right of withdrawal granted by law to consumers may be excluded. By purchasing single hours, hour packages, study materials, and ebooks from MB Toptutor Academy, the customer accepts the exclusion of the right of withdrawal for the purchase made.

 

VII. Intellectual Property

​

Lessons, study materials, ebooks of MB Toptutor Academy, and any other material or service offered by the website are protected by copyright. Therefore, any reproduction or unauthorized disclosure expressly not permitted by MB Toptutor Academy is prohibited. By purchasing the products or services of MB Toptutor Academy, the customer expressly accepts this clause. Any copyright infringement covering the products and services provided by MB Toptutor Academy will be pursued through the appropriate legal channels.

 

VIII. Instructions for Use of the Service

  1. In order to use the services and products of MB Toptutor Academy, the customer must register on the MB Toptutor Academy platform via the form available on the website.

  2. To properly use the service provided by MB Toptutor Academy, the customer must use the Google Meet application, as MB Toptutor Academy delivers its services exclusively through this platform.

  3. By using the MB Toptutor Academy website/application, you agree to comply with these Terms and Conditions. Continued use of MB Toptutor Academy after the posting of modifications implies acceptance of being legally bound by these updated and/or amended terms.

II. Paslaugos pobūdis

​

  1. MB Toptutor Academy teikia nuotolinių pamokų paslaugas internetu, pagrįstas atskirų valandų, „valandų paketų“ bei specialiai parengtų mokomųjų priemonių ar el. knygų įsigijimu, siekiant patenkinti įvairius mokinių ugdymosi poreikius.

 

III. Atsakomybės apribojimas

​

  1. MB Toptutor Academy neatsako už technines problemas, susijusias su interneto ryšiu, kurios nepriklauso nuo MB Toptutor Academy ar jos mokytojų. Todėl, jei pamoka nevyksta dėl kliento ryšio problemų, ji nebus kompensuojama.

  2. Jei mokinys neatvyksta į pamoką, ji nėra kompensuojama.

  3. Vėlavimo atveju prarastas laikas nėra kompensuojamas. Galimybė jį atsiimti yra išimtinai mokytojo nuožiūra, tačiau MB Toptutor Academy nemoka mokytojui jokio papildomo atlygio, išskyrus fiksuotą valandinį tarifą, nustatytą tarp MB Toptutor Academy ir jos mokytojų.

 

IV. Vartotojo paskyra ir turinio apribojimai

​

  1. MB Toptutor Academy studento paskyra gali naudotis tik pilnamečiai mokiniai arba nepilnamečių tėvai, o nepilnamečiai – tik su aiškiu tėvų leidimu.

  2. Vartotojams, tiek mokytojams, tiek mokiniams, draudžiama per MB Toptutor Academy svetainę ar paslaugą skelbti ar perduoti bet kokią neteisėtą, kenksmingą, grasinančią, priekabiavimo pobūdžio, šmeižikišką, vulgarų, nešvankų, seksualiai atvirą, diskriminuojantį ar kitaip netinkamą turinį, įskaitant, bet neapsiribojant, turinį, kuris skatintų veiklą, sudarančią nusikaltimą, sukeltų civilinę atsakomybę ar pažeistų bet kokius vietinius, valstybinius, nacionalinius ar tarptautinius įstatymus.

 

V. Užsakymas, kainos, mokėjimo būdai ir atšaukimas

​

  1. Atskirų valandų ir pamokų paketų pirkėjai turi būti ne jaunesni nei 18 metų. Mes pasiliekame teisę atsisakyti teikti paslaugą bet kam, bet kada ir dėl bet kokios priežasties.

  2. Pateikus užsakymą, klientai gaus patvirtinimo el. laišką su užsakytų produktų detalėmis ir apmokėjimo kvitu.

  3. MB Toptutor Academy pasilieka teisę bet kada atšaukti užsakymą dėl nenumatytų aplinkybių. Tokiu atveju kliento sumokėta suma bus grąžinta.

  4. Pamokų paketai, mokomosios priemonės ir el. knygos apmokamos tik internetu. Mes priimame šiuos mokėjimo būdus: kredito arba debeto kortelės [Visa, MasterCard] ir PayPal.

  5. Įsigyti pamokų paketai, atskiros valandos, mokomosios priemonės ir el. knygos nėra grąžinamos.

  6. Visos kainos gali būti keičiamos be išankstinio įspėjimo.

  7. Klientai gali atšaukti pamoką ne vėliau kaip likus 24 valandoms iki sutarto laiko. Vėliau atšaukta pamoka laikoma įvykusia.

  8. Norėdamas atšaukti pamoką, klientas privalo prisijungti prie savo Bookeo paskyros, integruotos į MB Toptutor Academy rezervuotą sritį, ir savarankiškai pateikti atšaukimo prašymą.

  9. Pamokų paketai ir atskiros valandos turi būti panaudoti per 9 mėnesius nuo įsigijimo. Pasibaigus šiam laikotarpiui, jie bus laikomi panaudotais, o norint tęsti paslaugą, juos reikės įsigyti iš naujo.

 

VI. Atsisakymo teisė

​

Internetinės prekybos atveju vartotojams įstatymu suteikta atsisakymo teisė gali būti panaikinta. Pirkdamas atskiras valandas, valandų paketus, mokomąsias priemones ir el. knygas iš MB Toptutor Academy, klientas sutinka, kad atsisakymo teisė netaikoma.

 

VII. Intelektinė nuosavybė

​

Pamokos, mokomosios priemonės, el. knygos bei kita MB Toptutor Academy siūloma medžiaga ar paslaugos yra saugomos autorių teisių. Todėl bet koks neteisėtas jų kopijavimas ar platinimas be aiškaus MB Toptutor Academy leidimo yra draudžiamas. Įsigydamas MB Toptutor Academy produktus ar paslaugas, klientas aiškiai sutinka su šia nuostata. Bet koks autorių teisių pažeidimas bus ginamas teisės aktų nustatyta tvarka.

 

VIII. Paslaugos naudojimo instrukcijos

  1. Norėdamas naudotis MB Toptutor Academy paslaugomis ir produktais, klientas privalo užsiregistruoti MB Toptutor Academy platformoje, užpildydamas svetainėje esančią formą.

  2. Norint tinkamai naudotis MB Toptutor Academy teikiama paslauga, klientas privalo naudoti „Google Meet“ programėlę, nes MB Toptutor Academy paslaugas teikia tik per šią platformą.

  3. Naudodamiesi MB Toptutor Academy svetaine/programėle, jūs sutinkate laikytis šių Taisyklių ir Sąlygų. Toliau naudojantis MB Toptutor Academy po pakeitimų paskelbimo laikoma, kad jūs sutikote būti teisiškai saistomi atnaujintų ir (arba) pakeistų taisyklių.
